Monet provides an AI-powered platform that enables users to create, customize and websites to the community through natural language prompts. Our Service includes website generation, editing tools, hosting capabilities, domain management, and related features.
The Service is provided on an "as available" basis. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, for any reason including but not limited to maintenance, upgrades, or business decisions.
We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service. We may also impose limits on certain features or restrict your access to parts or all of the Service without notice or liability.
User Accounts

Account Responsibilities

- To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service
- To attack the Service via a denial-of-service attack or a distributed denial-of-service attack
- To create websites containing illegal, harmful, threatening, abusive, harassing, or offensive content
- To infringe upon the intellectual property rights of others
Intellectual Property
Your Content
You retain all rights to content you create using our Service, including text, images, designs, and websites ("User Content"). By using Monet, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to:
- Use, reproduce, and display your User Content as necessary to provide the Service
- Store, and backup your User Content on our servers
- Perform technical modifications to your User Content to ensure compatibility with the Service
This license exists only for the limited purpose of operating and improving the Service, and ceases when you delete your content or account, except for content that has been shared with others.
Our Platform
The Service and its original content, features, and functionality are owned by Monet. And are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
Our trademarks, logos, and service marks displayed on the Service are our property. You are not permitted to use these marks without our prior written consent.
AI-Generated Content
Content generated by our AI technology based on your prompts is provided to you with full usage rights. However, you are solely responsible for ensuring that your use of AI-generated content complies with applicable laws and does not infringe upon the intellectual property rights of third parties.
Payment and Subscriptions
Certain features of the Service require payment. By subscribing to a paid plan, you agree to the following terms:
Billing Terms
- Pay all fees associated with your chosen subscription plan
- Provide accurate and complete billing information
- Authorize automatic recurring charges for subscription plans
- Update your payment information promptly if it changes
Subscription Renewal
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription fee for the renewal period.
You can cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period, and you will retain access to paid features until that time.
Refund Policy
All fees are non-refundable except as required by law or as explicitly stated in our refund policy. We do not provide refunds or credits for partial months of service, upgrade or downgrade refunds, or refunds for months unused with an open account.
If you believe you have been incorrectly charged, please contact our support team within 30 days of the charge.
Price Changes
We reserve the right to change our pricing at any time. Price changes for existing subscriptions will be communicated at least 30 days in advance and will take effect at the next renewal period. Your continued use of the Service after the price change constitutes acceptance of the new pricing.
Termination
Termination by You
You may cancel your account at any time through your account settings or by contacting our support team. Upon cancellation, you will retain access to paid features until the end of your current billing period, after which your account will be downgraded to the free tier or deactivated based on your preference.
Termination by Us
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:
- Breach of these Terms
- Violation of applicable laws or regulations
- Fraudulent, abusive, or illegal activity
- At our sole discretion for any other reason
Effect of Termination
Upon termination, your right to use the Service will immediately cease. We will make reasonable efforts to provide you with the ability to export your content for a limited period following termination, but we are not obligated to maintain your content after termination. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICE, INCLUDING BUT NOT LIMITED TO:

- ACCURACY, RELIABILITY, OR QUALITY OF THE SERVICE
- THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
- THAT DEFECTS WILL BE CORRECTED
- THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
You understand and agree that you use the Service at your own risk. We do not warrant that the results obtained from the use of the Service will be accurate, reliable, or meet your requirements.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MONET, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
- DAMAGES FOR PERSONAL INJURY OR PROPERTY DAMAGE
- UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS
- INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE
- BUGS, VIRUSES, OR OTHER HARMFUL CODE THAT MAY BE TRANSMITTED THROUGH THE SERVICE
- ERRORS OR OMISSIONS IN ANY CONTENT
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless MONET, its officers, directors, employees, agents, licensors, and suppliers from and against any claims, actions, demands, liabilities, judgments, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of or inability to use the Service
- Your violation of these Terms
- Your violation of any rights of a third party, including intellectual property rights
- Any content you create, upload, or publish through the Service
- Any websites you create using the Service
- Your violation of any applicable laws or regulations
We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.
Changes to Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect.
We will notify you of material changes through the Service, via email to the address associated with your account, or through other reasonable means. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service and may cancel your account.
It is your responsibility to review these Terms periodically for changes. Your continued use of the Service following the posting of any changes constitutes acceptance of those changes.
Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Rwanda without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Service shall be resolved through the following process:
Informal Negotiations
Contact us at legal@monet.ai to attempt to resolve the dispute informally for at least 30 days.
Binding Arbitration
If informal negotiations fail, disputes will be resolved through binding arbitration under the rules of the American Arbitration Association.
Jurisdiction
You agree to submit to the personal jurisdiction of the courts located in San Francisco County, California for any actions not subject to arbitration.
Class Action Waiver
You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually. To the full extent permitted by law, no arbitration or proceeding shall be joined with any other, no dispute shall be arbitrated on a class-action basis, and there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

Additional Provisions
Severability

Entire Agreement
These Terms constitute the entire agreement between you and Malos Technologies . regarding the Service and supersede all prior agreements.
Waiver
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.
Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
